GENERAL

• This document contains the general conditions according to which BOTEV TRADE EOOD, through its Internet store store.botevplovdiv.bg, provides services to its Customers. These terms are binding on all customers. By pressing the "Confirm" button, the Customer agrees, accepts and undertakes to comply with these general terms and conditions.
• Identification of the Customer for the purpose of reproducing his statement both for acceptance of the general terms and for the order made, is carried out through the log files stored on the server of store.botevplovdiv.bg, storage of the IP address of the Customer, as well as any other information.
• The products found on the website of store.botevplovdiv.bg do not represent a legally binding offer, but are rather a demonstrative online catalog describing the product line of BOTEV TRADE EOOD.
• After pressing the "Confirm" button, customers agree to purchase the goods in the "Basket". This action is legally binding. The customer receives confirmation of the order and upon receipt of this confirmation, the contract is deemed to be concluded.
• BOTEV TRADE EOOD reserves the right to refuse delivery of a confirmed order in case the goods are not available. In case of lack of stock availability of the requested product within the working week, BOTEV TRADE EOOD notifies the Customer of its depletion by sending a message to the e-mail address specified by the Customer or to the specified telephone number. In the event that a transfer is made to the account of BOTEV TRADE EOOD, the Customer will be able to choose between a refund, cancellation of the order or a replacement order.

WARRANTY PERIODS

• BOTEV TRADE EOOD offers its customers a warranty document for a given purchased product, if such a document is provided by the manufacturer of the product. The document describes: address and phone number of the authorized service centers of the purchased goods, warranty conditions of the relevant service centers or manufacturers, warranty period of the goods purchased by the customer.

PRICES

• The prices indicated on the site do not include packaging and transportation to the Customer. The price of the transport is calculated and the Customer is notified by an employee of store.botevplovdiv.bg about the most advantageous transport option. The cost of the transport/courier service is paid directly to the courier company. BOTEV TRADE EOOD will comply with the Customer's preferences regarding the choice of the courier company.

OBLIGATIONS OF THE CUSTOMER

• The customer has the opportunity to view and, after registration, order the advertised goods on the online store store.botevplovdiv.bg.
• The customer has the right to be informed about the status of his order.
• The customer is fully responsible for the protection of his username and password, as well as for all actions performed by him or a third party using the username and password. The customer is obliged to immediately notify BOTEV TRADE EOOD of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.
• The customer is obliged to pay the price of his order according to the announced method on the page store.botevplovdiv.bg.

• Every Customer, regardless of whether he is a customer of BOTEV TRADE EOOD, undertakes when using the services:
• not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and laws of the Republic of Bulgaria and recognized international acts;
• not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious enmity;
• not to violate others' property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
• to comply with Bulgarian legislation, applicable foreign laws, rules of morality and good manners and Internet ethics when using the services provided by BOTEV TRADE EOOD;
• to immediately notify BOTEV TRADE EOOD of any case of committed or discovered violation when using the provided services;
• not to upload, send, transmit, distribute or use in any way and not to make available to third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems ("Trojan horses"), computer codes or materials designed to interrupt, hinder, disrupt or limit the normal operation of computer hardware or software or telecommunications facilities or intended to gain unauthorized access to or access to foreign resources or software;
• not to commit malicious acts;
• to indemnify BOTEV TRADE EOOD and all third parties for all damages suffered and lost profits, including for any costs and paid attorney's fees, incurred as a result of claims made by and/or compensation paid to third parties in connection with Internet pages, hyperlinks , materials or information that the Customer has used, placed on the server, sent, distributed, disclosed to third parties or made available through store.botevplovdiv.bg in violation of the law, these General Terms and Conditions, good manners or Internet ethics;
• The customer undertakes to indicate an accurate and valid telephone, delivery address and e-mail address, to pay the price of the goods, to pay the costs of delivery when the same is not free, and to ensure access and the possibility of receiving the goods. In the event that it is not explicitly stated that the delivery is free, it is considered paid.

• The customer has the right to cancel the order within 14 days from the date of delivery. When exercising his right of refusal, the Customer pays the transport costs to the warehouse of BOTEV TRADE EOOD.

• The customer has the right to cancel the order within 24 hours, provided that he did not receive the product he ordered, but a different one.

RIGHTS AND OBLIGATIONS OF BOTEV TRADE EOOD

• BOTEV TRADE EOOD does not have the obligation and the objective possibility to control the way in which the Clients use the services provided.
• BOTEV TRADE EOOD has the right, but not the obligation, to save materials and information located on the store.botevplovdiv.bg server
• BOTEV TRADE EOOD has the right at any time, without notifying the Client, when the latter uses the services in violation of these conditions, as well as at the discretion of BOTEV TRADE EOOD, to terminate, stop or change the services provided in connection with the use of the site. BOTEV TRADE EOOD is not responsible towards customers and third parties for damages suffered and lost benefits that occurred as a result of the termination, suspension, change or limitation of services, deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used, recorded or made available through store.botevplovdiv.bg.
• After receiving the payment, BOTEV TRADE EOOD undertakes to transfer to the Customer the ownership of the goods requested for purchase by him, to deliver the goods requested for purchase on time, to check the technical condition of each item before it is sent (in the event that this is possible without breaking the integrity of the package).

• BOTEV TRADE EOOD is not responsible for damages caused to software, hardware or telecommunications equipment or for loss of data resulting from materials or resources searched, loaded or used in any way through the services provided. The advice, consultations or assistance provided by the specialists and employees of BOTEV TRADE EOOD in connection with the use of the services by customers do not give rise to any responsibility or obligations for BOTEV TRADE EOOD. The company is not responsible if the information provided by the manufacturer about the product is incorrect.

• BOTEV TRADE EOOD has the right to collect and use information relating to its Customers, regardless of whether they are registered.

• The information under the previous article can be used by BOTEV TRADE EOOD, except in case of express disagreement of the Client, sent to the following e-mail address [email protected]. BOTEV TRADE EOOD collects and uses the information to improve the services offered. All purposes for which BOTEV TRADE EOOD will use the information will be in accordance with Bulgarian legislation, applicable international acts and good morals.

• BOTEV TRADE EOOD is not responsible for failure to fulfill its obligations under this contract in the event of circumstances that BOTEV TRADE EOOD did not foresee and was not obliged to foresee - including cases of random events, problems in the global Internet network and in providing of the services beyond the control of BOTEV TRADE EOOD

• BOTEV TRADE EOOD has the right to install cookies on customers' computers. Cookies are text files that are saved by the Internet page on the Customer's hard drive and allow the recovery of information about the Customer, identifying him and allowing the tracking of his actions, the Internet pages he visits, the hyperlinks he uses, the information that uses and records and others.

• BOTEV TRADE EOOD has an obligation to refund the amount of the order within 14 days after notification of refusal of purchase. This applies to products with intact commercial packaging, unused and in good commercial condition. Otherwise, BOTEV TRADE EOOD has the right to withhold an amount according to the degree of use of the product.

PERSONAL DATA

• BOTEV TRADE EOOD guarantees its Customers the confidentiality of the information and personal data provided. The latter will not be used, provided or brought to the knowledge of third parties outside of the cases and under the conditions specified in these General Terms and Conditions. BOTEV TRADE EOOD protects the Customer's personal data, which became known to him when filling out the electronic form for making a purchase application, and this obligation is waived in the event that the Customer has provided incorrect data. In compliance with the current legislation and the clauses of these General Terms and Conditions, BOTEV TRADE EOOD can use the Customer's personal data solely and only for the purposes provided for in the contract. Any other purposes for which the data is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.

• BOTEV TRADE EOOD undertakes not to disclose any personal data about the Client to third parties - state authorities, commercial companies, individuals and others, except in cases where it has received the express written consent of the Client, the information is requested by state authorities or officials , which according to current legislation are authorized to request and collect such information. BOTEV TRADE EOOD is obliged to provide the information under the law.

CHANGES

• The General Terms and Conditions may be changed at any time by BOTEV TRADE EOOD, which has the right to change the characteristics of the services provided and the present General Terms and Conditions and on the basis of changes in the legislation. BOTEV TRADE EOOD undertakes to notify the Client of the changes in the General Terms and Conditions by publishing a notice of the changes in a prominent place on its website and giving the Client sufficient time to become familiar with them. In the given period, if the Client does not state that he rejects the changes, he is considered bound by them. In the event that the Client states within the given period that he does not agree with the changes, BOTEV TRADE EOOD has the right to immediately suspend or terminate the provision of services to the Client.

WARRANTY

• The commercial guarantee of goods is served by their importers/manufacturers. BOTEV TRADE EOOD issues a valid warranty card with the terms of the warranty and a fiscal document for the purchase.

• For inflatable products - pools, mattresses, etc. - the warranty covers manufacturing defects such as poor seam adhesion. The warranty does not cover product bursting, nicks and holes caused by its use and cleaning chemicals used.

• In the event of a claim on purchased goods, the costs of transporting the goods to the service center are for the account of the Customer.

TERMINOLOGY

• "Customer" means anyone who has downloaded the website of the store.botevplovdiv.bg online store on their computer or other electronic device.

• "Order" means the selected product, as well as all other attributes related to the method of delivery and payment for the same by the customer.

• The online store store.botevplovdiv.bg is owned by BOTEV TRADE EOOD.

• All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes to fill gaps in the contract or adapt it to new circumstances, will be resolved by the competent court for registration of BOTEV TRADE EOOD, in accordance with Bulgarian legislation.
